Terms of Service

1. Acceptance of Terms

By browsing, registering an account, publishing content, submitting an RFQ, or utilizing any functionality on Construction.lk (the “Service” or “Platform”), you certify that you have read, understood, and agree to comply with these Terms, as well as our Privacy Policy.

If you are registering an account on behalf of a company, partnership, or commercial contractor, you represent that you have legal authority to bind that entity to this agreement.

2. Eligibility & Account Registration

• Age: You must be at least 18 years old or the age of legal majority in Sri Lanka to enter into contracts and create an account.
• Account Accuracy: You agree to provide true, current, and complete registration details, whether signing up via Google Authentication or phone SMS OTP.
• Account Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. User Conduct & Acceptable Use

When using the platform, you agree NOT to:

• Submit misleading, fraudulent, defamatory, or unlawful business listings, reviews, or quotation requests.
• Impersonate another enterprise, government body, or licensed engineer/architect.
• Deploy scrapers, spiders, or automated bots to extract database contents without prior written consent.
• Attempt to breach the security, reverse engineer, or disrupt the server infrastructure or APIs of Construction.lk.

5. Vendor Listings & RFQ Transactions

Business owners and vendors who publish listings and product catalogs warrant that they possess all necessary local council clearances, business registration certificates (BR), and professional certifications to practice or sell listed merchandise in Sri Lanka.

We reserve the right, without prior notice, to unpublish, modify, or ban listings that violate our community standards or attract repeated verified customer fraud complaints.

6. Fees, Subscriptions & Payments

Certain premium services, including featured advertising banners, Gold Partner subscriptions, and enhanced catalog tiers, require monetary payments.

• All prices are quoted in Sri Lankan Rupees (LKR) inclusive of applicable taxes unless specified otherwise.
• Payments are processed securely via Central Bank authorized third-party gateways (PayHere).
• Unless otherwise stated under our Return & Cancellation Policy, sponsorship fees and advertising slot purchases are non-refundable once activated on the live site.

7. Intellectual Property Rights

All logos, trademarks, website layout, database arrangements, source code, and custom software created for Construction.lk remain the exclusive intellectual property of Construction.lk.

Listed business owners retain ownership of their uploaded brand logos and project portfolio photos, granting Construction.lk a worldwide, royalty-free license to host, display, and promote their business profile on the platform.

8. Platform Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, CONSTRUCTION.LK DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

UNDER NO CIRCUMSTANCES SHALL CONSTRUCTION.LK, ITS DIRECTORS, OR OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM TRANSACTIONS CONDUCTED BETWEEN DIRECTORY USERS AND THIRD-PARTY CONTRACTORS.

9. Indemnification

You agree to defend, indemnify, and hold harmless Construction.lk and its officers from any claims, liabilities, damages, and legal expenses arising out of your breach of these Terms or your infringement of third-party intellectual property or contractual rights.

10. Account Termination & Suspension

We reserve the right to suspend or terminate any user or vendor account immediately if we detect malicious activity, fraudulent documentation, chargeback abuse, or repeated violations of these Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the substantive laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising in connection with the Platform shall be subject to the exclusive jurisdiction of the competent courts of Colombo, Sri Lanka.
